951.01 DEFINITIONS.
   As used in this chapter:
   (a)   “Bulk material” includes furniture, appliances, including “white goods” (provided that white goods containing Chlorofluorocarbons (CFC’s) display satisfactory evidence of CFC removal by a certified technician), boards, fencing, paneling, carpeting, etc.
   (b)   “Commercial Refuse” includes automobile or truck parts, tree trunks and construction materials, such as broken concrete. Collection of significant quantities of commercial refuse shall be classified as “extra service”, and may be handled by the Village or its Contractor at rates specified by the Village or its Contractor, with payment made by the subscriber directly to the Village or its Contractor.
   (c)   “Contractor” means the holder of a lawful contract to undertake under the Village’s authority, the collection of residential garbage and refuse. As used in this chapter, “Contractor” also means the employees or representatives of the holder of a lawful contract.
   (d)   “Garbage” includes all putrescible wastes, except sewage and body waste, and includes vegetable and animal offal, but excludes recognizable industrial by- products.
   (e)   “Hazardous Waste” means those substances used either for household, commercial, industrial or institutional purposes which, singularly or in combination, pose a significant present or potential threat or hazard to human health or to the environment, and which singularly or in combination, require special handling, processing or disposal because they are or may be flammable, explosive, reactive, corrosive, toxic, carcinogenic, bioconcentrative or persistent in nature, potentially lethal, or an irritant or strong sensitizer or designated hazardous by the Village or any federal or state agency. Hazardous waste shall include the following items: motor oil, gasoline, paint, paint cans, turpentine, kerosene and/or any other substance designated as hazardous by the Village Administrator.
   (f)    "Householder" means the head of a family or one maintaining his or her separate living room or quarters in the Village, and includes owners, tenants and occupants of all single-family and two-family residential premises from which garbage or refuse, or both, are generated.
   (g)    "Infectious waste" means those wastes identified in Ohio Administrative Code 3745-27-01 (V).
   (h)    "Loose material" includes rocks, bricks, blocks, dirt, sand, cement, etc.
   (i)    "Recyclables" are defined as newspaper, magazines, aseptic containers, gable top cartons (milk, juice, half & half, etc.) beverage glass (clear, green, brown), aluminum and bi-metal beverage cans, aluminum foil, pie pans, steel food cans, and #1 and #2 plastics.
   (j)    "Recycling Bin" means a storage unit in which recyclable material is to be placed by the occupants of residential premises. Such bin shall meet the requirements of the Village Administrator.
   (k)    "Refuse" or "rubbish" includes non-putrescible non-liquid wastes, such as ashes, cinders, tin cans, glass, bottles, rags, wastepaper, wood and paper boxes, grass, tree and shrub trimmings, tree and shrub stumps, large household objects such as furniture and appliances, bricks, concrete, dirt, rocks, sand, gravel and remodeling materials. Refuse is limited only by what is generated by the household and shall not include that from a home-operated business.
   (l)    "Residential" means single-family and two-family dwelling structures, excluding mobile homes located within mobile home parks.
   (m)    "Subscriber" means any residential householder within the Village except an owner, tenant or occupant of a three (3) or more family dwelling.
   (n)    "Solid Waste" means all bulk material, waste, garbage, refuse, rubbish, yard waste and recyclable material. Solid waste shall not include and does not mean any construction waste, hazardous waste or infectious waste.
   (o)    "Village" means the area within the corporate boundaries of the Village of Plain City, and the municipal corporations's duly elected or appointed representatives.
   (p)    "White Goods" means large items such as appliances, metal furniture, or any metallic item too large to fit into an acceptable container as defined in Section 951.02 .
   (q)    "Yard waste" includes inedible grass, leaves, brush, trees (including Christmas trees), shrub trimmings and small shrubs.
