(a) For Zoning Districts: RS1, RS2, RS2A, and RS3. A proposed Subdivision of a parcel of land along an existing Public Street in any RS1, RS2, RS2A, and RS3 Zoning District, not involving the opening, widening or extension of any street, road or access point and involving an existing tract of land from which no more than five lots can be created, that meet the current lot requirements for such zoning district, after the original tract has been completely subdivided, may be submitted to the Planning and Zoning Commission for approval without plat. If the commission is satisfied that such proposed subdivision complies with applicable zoning requirements, that the subdivision will not necessarily preclude anticipated future development or redevelopment, and the proposed subdivision does not interfere with the provision of Village services, the Commission may direct the Village Administrator to stamp conveyances for Lots within the Subdivision "Approved by Planning and Zoning Commission. No Plat Required." The Commission may also establish reasonable necessary procedures and requirements to be met by the owner desiring to subdivide property pursuant to this section. This may include: requirements for the extension or improvement of public infrastructure to support the subdivision or possible growth or development for the area; additional specific provisions required by the Commission, of the subdivision requirements, or other requirements that are in the interest of the Village to be included as a provision of the approval of the subdivision without plat. No Zoning permit of Certificate of Zoning Compliance shall be issued until all provisions stipulated by the Commission have been completed and accepted by the Village in accordance with the site development process.
(b) Districts other than RS 1, RS2, RS2A, RS3. A proposed Subdivision of a parcel of land along an existing Public Street in all districts other than RS 1, RS2, RS2A, RS3, not involving the opening, widening or extension of any street, road or access point and involving a tract of land from which no more than five Lots can be created after the tract has been completely subdivided, may be submitted to the Planning and Zoning Commission for approval without Plat. If the Commission is satisfied that such proposed Subdivision complies with applicable Zoning requirements, the proposed subdivision does not interfere with the provision of Village services and that the subdivision is not contrary to the interest of the Village and the subdivision does not necessarily preclude anticipated future development or redevelopment, the Commission shall recommend to Council approval, or approval with modification of such request, for Subdivision without Plat. Otherwise the Commission shall disapprove the request for Subdivision without Plat. After approval or, approval with modification of the Subdivision without Plat by the Commission, Council may either approve or reject such request by resolution. A Super Majority is required for Council to reject the recommendation of the Commission. If Council elects to approve the Subdivision, it shall authorize the Village Administrator to stamp the conveyance of such parcel "Approved by Village Council: No Plat Required." The Commission and/or Council may establish reasonable necessary procedures and requirements to be met by the owner desiring to subdivide property pursuant to this section. This may include: requirements for the extension or improvement of public infrastructure to support the subdivision or development for the area; additional specific provisions required by the Commission, of the subdivision requirements, or other requirements that are in the interest of the Village to be included as a provision of the approval of the subdivision without plat. (c) Filing Fee. Each application submitted and processed pursuant to this section shall be accompanied by a filing fee of one hundred fifty dollars ($150.00). See Section 1135.04(q).
