§ 90.104 FINANCIAL RESPONSIBILITY; MINIMUM INVESTMENT; PERSONNEL REQUIREMENTS.
   (A)   All tenants shall be required to furnish evidence of financial ability in the field for which they seek a contract, including, but not limited to, a profit and loss statement and/or balance sheets prepared by public accountants.
   (B)   All tenants shall show evidence of a minimum investment in aircraft used for the following services for which they seek operating privileges:
      (1)   Flight training, $ 4,000
      (2)   Aircraft rentals, $4,000
      (3)   Air taxi, $10,000
      (4)   Parts and equipment, $5,000
   (C)   Aircraft referred to in division (B) above does not necessarily have to be owned, but can be leased, in writing, to the lessee. This applies to flight training, aircraft rentals and air taxis.
   (D)   All tenants shall employ the following minimum number of personnel of good moral character who are schooled, trained and competent for their assigned duties in aircraft use operating privileges. Allowance may be made for personnel properly qualified to serve in a dual purpose capacity.
      (1)   Flight training: one full time employee.
      (2)   Aircraft rentals: one full time employee.
      (3)   Air taxi: one full time or part time employee.
      (4)   Aircraft maintenance: one full time or one part time employee.
   (E)   All tenants contracting for flight training privileges shall be required to provide one person properly certificated by the FAA as a flight instructor to cover the type of training offered.
   (F)   All tenants contracting for air taxi privileges shall provide an FAA ATCO certificate and a State Charter Air Carrier Certificate.
