§ 75.10 SCOPE AND EFFECT OF SIZE, WEIGHT, AND LOAD REGULATIONS.
   (A)   It is unlawful for any person to drive or move on, upon, or across, or for the owner to cause to knowingly permit to be driven or moved on, upon, or across any highway any vehicle or vehicles of a size and weight exceeding the limitations stated in ILCS Ch. 625, Act 5, §§ 15-100 et seq., or otherwise in violation of ILCS Ch. 625, Act 5, §§ 15-100 et seq.
   (B)   The provisions of ILCS Ch. 625, Act 5, §§ 15-100 et seq. governing size, weight, and load do not apply to fire apparatus or equipment for snow and ice removal operations owned or operated by the city, or to implements of husbandry, as defined in ILCS Ch. 625, Act 5, §§ 1-101 et seq., temporarily operated or towed in a combination upon a highway provided such combination does not consist of more than three vehicles or, in the case of hauling fresh, perishable fruits or vegetables from farm to the point of first processing, not more than three wagons being towed by an implement of husbandry, or to a vehicle operated under the terms of a special permit.
   (C)   (1)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CLASS A STREETS. Streets and alleys surfaced or improved with concrete or brick.
      CLASS B STREETS. Streets and alleys surfaced or improved with gravel or bituminous products.
      CLASS C STREETS. Streets and alleys with no surfacing or improvements.
      (2)   Maximum weight generally. No vehicle or combination of vehicles shall be operated, loaded, or unloaded upon the streets and alleys of the city when the gross weight on the road surface through any axle thereof exceeds 16,000 pounds, except, however, that on Class A and Class C streets the gross weight on the road surface through any axle may not exceed 18,000 pounds. The superintendent of the street department may designate various Class B streets or portions thereof which can safely accommodate 18,000 pounds per axle and, as to those so designated, the maximum axle load shall be 18,000 pounds.
      (3)   Winter operation. No vehicle shall be operated upon any street or alley of a Class B or C designation from October 15 through March 15 inclusive, whenever any such street or alley, by reason of deterioration, rain, snow, or other climatic condition, will be seriously damaged or destroyed by the operation.
      (4)   Waiver. Upon a showing of hardship, the superintendent of the street department may permit oversize loads to traverse streets and alleys and may permit prohibited vehicular operation upon alleys; permission shall be conditioned upon observance of measures recommended by the superintendent calculated to minimize the damage to the street or alley.

   (D)   Designation of Class II and Class III highways.
      (1)   Section 1-126.1 of the Illinois Vehicle Code (ILCS Ch. 625, Act 5, § 1-126.1) provides that local authorities may designate Class II or Class III highways within their jurisdiction.
      (2)   The following routes are designated as a Class II highway: from Martinsburg Road to Clarksville Road to Fayette Street, and Fayette Street between Memorial Street and Jackson Street.
   (E)   Violation. No person shall use the highways under the jurisdiction of the city in violation of weight and location restrictions and commercial vehicle restrictions set forth in any applicable ordinance.
