(A) This section is enacted to maintain the aesthetic appeal, cleanliness, and safety of the city's right-of-way. The purpose of this section is to prohibit the placement of trash receptacles on city right-of-way except as otherwise provided.
(B) Definitions.
CITY RIGHT-OF-WAY. Any public street, alley, sidewalk.
TRASH RECEPTACLE. Any container or bin used for the collection or disposal of waste, garbage, or refuse.
(C) Prohibition of trash receptacles on city right-of-way.
(1) Except as otherwise provided in this section, it shall be unlawful for any person, entity, or organization to place, install, or maintain any trash receptacle on the city's right-of-way.
(2) The prohibition in division (C)(1) shall not apply to:
(a) City-designated areas: Trash receptacles designated and installed by the city in specific areas within the right-of-way.
(b) Authorized events: Temporary trash receptacles provided by event organizers with prior approval from the city for special events or gatherings taking place on the city's right-of-way.
(c) Temporary construction receptacles with prior approval from the city.
(d) Within 24 hours of the scheduled garbage pickup.
(D) Removal of unauthorized trash receptacles.
(1) If any trash receptacle is found on the city's right-of-way in violation of this section, the city may remove or cause the removal of such receptacle without prior notice.
(2) The costs incurred by the city in removing unauthorized trash receptacles may be charged to the person, entity, or organization responsible for placing the receptacle.
