§ 153.16 NONCONFORMITIES.
   (A)   (1)   Any lighting fixture lawfully in place or approved by the town prior to the adoption of these lighting standards shall be exempt from the provisions of this chapter.
      (2)   At the time that a non-conforming fixture is replaced, moved, upgraded, or otherwise changed, the fixture must be brought into compliance with the requirements of this chapter.
      (3)   Any expansion of, or addition to, an existing lighting system must conform to the requirements of these lighting standards.
   (B)   (1)   Routine maintenance, including changing the lamp, ballast, starter, photo control, lens, and other required components, is permitted for all existing fixtures.
      (2)   When the fixture housing is changed, the fixture must come into compliance. (Elevations)
   (C)   (1)   Property owners that install lighting fixtures after the effective date of these lighting standards and are found to be in non-compliance shall receive written notification and will be given 90 calendar days from the date of written notification to bring the lighting system into compliance.
      (2)   Under extenuating circumstances, such as unavailability of compliant equipment, the property owner may apply for an extension of time to be determined by the town’s Planning Department.
