(A) A permit shall be secured from the town prior to the construction of any new access or the alteration of any existing access within the right-of- way of a street maintained by the town or any street or road maintained by the state within the extra territorial jurisdiction of the town; provided, however, permits for single-family residences are required only where access connections involve a public safety hazard or at locations involving a street construction project.
(B) A new permit shall also be required prior to the change or alteration of the existing use of property. Failure to secure a permit prior to construction or change in the use of the property may result in the removal of the driveway or street connection at the property owner’s expense.
