§ 56.08 ILLICIT DISCHARGE PROHIBITED.
   (A)   There shall be no illicit discharge permitted as defined in § 56.02 from any property.
   (B)   Illegal dumping is prohibited. A minimum of $250 and up to $1000 depending on severity of dumping.
   (C)   Upon discovery of illicit discharge or illegal dumping, the enforcement officer shall notify the property builder/owner of the violation and issue a cease and desist order. The enforcement officer shall develop a plan and timeline with the property owner to eliminate the violation. Should the illicit discharge and/or illegal dumping not be eliminated within the timeline issued, the homeowner shall be fined $250 for the violation.
      (1)   Should the property builder/owner not correct the violation after the fine is issued, the city shall remedy the issue and assess the costs to the property owner.
      (2)   Should the same property have a subsequent violation, the property builder/owner on all subsequent violations shall be assessed a civil fine of up to $1,000 if not remedied within the issued timeline.
      (3)   Should the same builder have multiple violations for the same issue, or combination of issues, the builder may be barred from construction activities within the city for a period of time determined by the City Manager.
