8-3-4: RESERVATION FOR PRIVATE ACTIVITIES AND GATHERINGS:
   A.   Permit Required: It shall be unlawful to conduct or attend any social gathering of persons which disrupts or blocks access to any village owned or maintained "park", as defined in section 8-3-1 of this chapter (hereafter referred to as a "private party"), unless a permit has been issued for such private party or gathering in accordance with this section.
   B.   Application For Permit; Fee:
      1.   Any person desirous of securing the permit required to host a private party shall file an application therefor with the village clerk upon a form provided by the village, setting forth the following information:
         a.   Proposed date of event and alternate date in case of rain.
         b.   Location of park to be affected by proposed event.
         c.   Hours during which the event is proposed to be held.
         d.   Name, address and telephone number of a person over the age of eighteen (18) years to be designated as the sponsor of the proposed event. In the event a proposed private party is sponsored by more than one person, each such sponsor should be listed.
         e.   Name and cellular telephone number of a sponsor serving as an emergency contact who can be reached at the cellular telephone number provided at all times during the pendency of the private party.
      2.   Applications shall be submitted, along with a nonrefundable review fee of fifty dollars ($50.00), or such other fee as shall be set by resolution of the village board, not less than thirty (30) days prior to the proposed date of the event.
   C.   Review Of Application; Denials: Applications shall be reviewed by the village clerk who may consult with the village engineers, village attorneys, or any other person deemed appropriate. Any denial of a request for a permit may be reviewed by the village board of trustees at the applicant's request. No permit shall be issued for any private party which may endanger the public health, welfare and safety.
   D.   Restrictions And Exemptions: Any permit issued pursuant to this chapter shall be subject to the following restrictions and exemptions:
      1.   No private party or gathering shall extend beyond ten o'clock (10:00) P.M. upon any portion of the park, nor shall any private party or gathering begin before seven o'clock (7:00) A.M.
      2.   No sidewalk, bike path or walking path located in a public park shall be completely blocked by any private party or gathering, but rather, access must be available for any person wishing to use the public right of way for either pedestrian or vehicular purposes.
      3.   No alcoholic liquor shall be sold at any private party or gathering.
      4.   The sponsor(s) shall be responsible for the removal of all litter, refuse or property deposited in the public park as a result of the private party or gathering at the end of such private party or gathering.
      5.   No person attending any private party or gathering in the public park shall make any loud noise or disturbance which will create a nuisance for persons not attending the private party or gathering.
      6.   The sponsor will be responsible for any costs incurred by the village for police response to a private party and cleanup or repair of public park used or damaged by a private party. The sponsor shall be required to sign a statement as to such responsibility at the time a permit is issued.
      7.   No private party shall be permitted to create or cause a breach of the peace. In the event a private party creates or causes a breach of the peace as determined by the village president, his designee, or any sworn law enforcement officer, such private party shall be immediately terminated.
      8.   No sponsor may reserve a park more frequently than once every three (3) months, and no park may be reserved for a private party on any legal holiday. Further, no private party may last more than two (2) consecutive days in any seven (7) day period with the party beginning and ending in accordance with the provisions of subsection D1 of this section.
   E.   Forms: The village clerk shall, in cooperation with village staff, develop the forms necessary to implement this section and to provide for indemnification of the village by the sponsors of any private party. (Ord. 2007-85, 11-5-2007)
