That certain municipal code of ordinances, dated 2011 and consisting of titles 1 – 12 of the village code of ordinances of the village of Pingree Grove, is hereby adopted, ratified and confirmed as the village code of ordinances for the village of Pingree Grove. Any and all provisions in said village code which may lawfully be adopted or ratified by this ordinance are so adopted and ratified.
Notwithstanding the foregoing, any ordinance or regulation which is not lawfully permitted to be approved or ratified by this action of the village board without some further process (e.g., public hearing) shall not be affected by the passage of this ordinance, and the version of such ordinance or regulation that is in effect at the time of passage of this ordinance shall remain in full force and effect. Any such ordinance which is not lawfully permitted to be approved or ratified by this action shall be considered to be added to the enumerated list of excluded ordinances set forth in section 1-2-1 hereof.
With specific reference to the zoning code of the village of Pingree Grove, codified at title 11 of the village code of ordinances, the village board notes that said code was not amended from the content that had previously been passed and established by the village pursuant to the statutorily required process involving public notice and hearings. Rather, the only change in such zoning code is the renumbering of sections so as to fit within this complete set of village codes. It is the intention of the village to utilize the renumbered sections as contained herein. However, should a court of competent jurisdiction determine that the use of said renumbered sections is invalid for any reason, the zoning code of the village, as previously numbered prior to the adoption of this village code of ordinances, shall remain in full force and effect.
To the extent that any court of competent jurisdiction determines that any ordinance in this village code is invalid by virtue of this codification/ratification process, the version of said ordinance in effect as of the date of passage of this ordinance shall remain in full force and effect until subsequently modified.
The passage of any ordinance after the effective date of this ordinance, which amends any provision of this village code of ordinances, shall supersede the current terms of this ordinance and of the village code to the fullest extent permissible under the law. (Ord. 2011-18, 7-5-2011)
