§ 152.538 CONDITIONAL USE PERMIT REQUIRED.

(A) All sexually-oriented businesses within the town’s planning jurisdiction shall require a conditional use permit issued by the Board of Commissioners pursuant to the normal conditional use permit process. (See §§ 152.040 through 152.062.)

(B) Permit applications shall proceed as expeditiously as possible and shall be completed within 60 days of the filing of the application.

(C) In the event a permit is denied for any reason, the applicant may appeal in the nature of certiorari to the county’s Superior Court.
