Residency in Pima County is a requirement of county subsidized medical care. After June 30, 1993, a person must also be of U.S. legal status except for emergency services as established in A.R.S. 11-297. The following shall be considered in determining residency:
A. Verification Documents. A person who applies for medical assistance in Pima County has the burden of proving that he/she has established a domicile in Pima County. The following documents may be considered in determining county residency:
1. An unexpired recent Pima County rent or mortgage receipt or utility bills in the name of the applicant or head of the applicant's household;
2. An unexpired Arizona driver's license showing a current Pima County address;
3. An Arizona vehicle registration showing a current Pima County address;
4. Evidence of recent employment in Pima County;
5. Evidence that the applicant is receiving public assistance as a resident of Pima County;
6. Evidence that the applicant has enrolled his/her child(ren) in the public schools of Pima County during the current school year or for the next school year if school is not in session;
7. Evidence of current registration to vote in Pima County;
8. Any other corroborative evidence similar to that listed above, subject to review by supervisory staff of the department;
9. The documents required to demonstrate U.S. legal status are the same as established by AHCCCS Administration for that purpose.
B. In addition to providing one of the residency documents set forth in subsection A of this section, a person who applies for medical assistance must sign a county affidavit attesting to residency. The affidavit shall not in itself establish residency in Pima County. Except for an application for emergency services, a person who applies for medical assistance must sign an affidavit attesting to U.S. legal status, specifying the specific ground upon which that claim of status is based.
C. A child is a resident of the county in which he/she resides with the natural or legally adoptive parent or legal guardian on a permanent basis. A child may attend school outside of the county and remain eligible as long as he/she remains in the care and custody of a natural or legally adoptive parent or legal guardian in Pima County.
D. For a family member who is separated from the household solely due to medical reasons, the residential address of the medical facility shall not be used to verify the county residency of the household.
