A. Unless otherwise provided in this title, contracts for the annual requirements of materials or services shall be entered into for an initial term of up to one year with up to four one-year renewals. The contract term and conditions of renewal or extension, if any, shall be included in the solicitation, and monies shall be available for the first fiscal period at the time of contracting. A contract may be entered into for an initial term exceeding one year if the director determines awarding such a contract would be advantageous to Pima County. Payment and performance obligations for succeeding fiscal periods are subject to the availability and appropriation of monies.
1. Before the execution of a contract exceeding one year, it shall be determined at time of award that:
a. Estimated requirements cover the period of the contract and are reasonable and continuing.
b. Such a contract will serve the best interest of Pima County by encouraging effective competition or otherwise promoting economies in Pima County procurement.
2. If monies are not appropriated or otherwise made available to support continuation of performance in a subsequent fiscal period, the multiple year contract shall be canceled and the contractor may only be reimbursed for the reasonable value of any nonrecurring costs incurred at the county's request, but not amortized in the price of the materials or services delivered under the contract, or which are otherwise not recoverable. The cost of cancellation may be paid from any funds available for such purposes.
