10.44.020   Permit.
   A.   Any person, contractor, firm, utility company or corporation desiring to dig any hole, drain, trench or ditch in any public street, alley, drainageway or thoroughfare, or remove or change any curb pavement or other constructed improvement now or hereafter existing in Pima County, or construct any paving, irrigation or landscaping or any other improvement, or construct any improvement for flood-control purposes in any public drainageway or drainage easement, shall first obtain written permission from the county engineer of Pima County, specifying that all such work shall be done in the manner specified in this chapter. After finding that the proposed construction does not interfere with the safety of the traveling public or the authorized public use of the right-of-way, and upon finding that the construction does not otherwise interfere with the general health, safety and welfare of the citizens of Pima County, said permission shall be given by the issuance of a permit by the county engineer to any person, contractor, firm, utility company or corporation desiring to do any of the aforementioned work. The county engineer or an authorized representative shall inspect the work for the compliance with this chapter, and conduct a final inspection prior to county acceptance of the work.
   B.   For the purposes of this chapter, any person, contractor, firm, utility company or corporation desiring to do said work, even if they hire a contractor to perform the actual work, shall be known as the "applicant."
   C.   Applicant may, at the time of filing his application for a permit, be required to post a satisfactory performance bond for one hundred percent of the cost of the work to be performed within Pima County rights-of-way. A cash bond or its equivalent equal in value to one hundred percent of the work to be performed in the public right-of-way may be substituted for a performance bond. This bond or its substitute will be held until the applicant's work has been completed and accepted. Applicant may be exempted from posting bond with the approval of the county engineer.
   D.   In order to mitigate impacts to Pima County rights-of-way and to protect the safety of the travelling public, access connections to Pima County rights-of-way shall conform to this chapter and to those provisions of the Subdivision and Development Street Standards governing connections to Pima County rights-of-way and those additional provisions of the Subdivision and Development Street Standards that the county engineer reasonably determines must be complied with to mitigate the direct impact of adjacent development to the Pima County right-of-way. The county engineer may issue a permit for a connection to a Pima County right-of-way only after finding that the proposed connection complies with this subsection.
