The board of supervisors, acting through the county engineer, shall expend public funds for such maintenance of public roads and streets located without the limits of an incorporated city or town in the county other than legally designated state and county highways as is vital to the public safety. In no event shall any maintenance he performed unless the road or street is laid out, opened and constructed as defined in this title without cost to the county, and in no event shall any rock products, cement or petroleum-product materials be purchased or used in performing such maintenance.
