8.56.110   Sanitary requirements for adult amusement establishments.
   A.   No person shall knowingly operate an adult amusement establishment in any manner which allows sexual intercourse or other sexual contact to occur between two or more persons on the premises.
   B.   No operator of an adult amusement establishment shall knowingly allow more than one person to be present in a private viewing booth of a peep show device at any time.
   C.   No person shall enter a private viewing booth of a peep show device that is occupied by another person.
   D.   No operator of an adult amusement establishment shall knowingly allow openings of any kind to exist between private viewing booths of peep show devices.
   E.   No person shall make or attempt to make an opening of any kind between private viewing booths of peep show devices.
   F.   The operator of an adult amusement establishment who discovers two or more persons in a private viewing booth or discovers any person making or attempting to make an opening of any kind between private viewing booths of peep show devices shall immediately escort such persons from the premises.
   G.   The operator of an adult amusement establishment who discovers an opening of any kind between private viewing booths of peep show devices shall immediately secure such private viewing booths and prevent entry into them by any member of the public until such time as the booth wall has been repaired to remove the opening. Removal and repair of openings between private viewing booths shall be in a manner that is as structurally substantial as the original booth wall construction.
   H.   The operator of an adult amusement establishment shall ensure that any door, curtain, wall or other partition covering the doorway of a private viewing booth of a peep show device shall end at least thirty inches above the highest floor level of the booth and provide a view of the occupant from at least the waist down when seated. The doorways of all private viewing booths shall be visible from a continuous main aisle.
   I.   No operator of an adult amusement establishment shall knowingly allow the doorway of any private viewing booth of a peep show device to be covered or otherwise obscured in any manner such that the operator cannot monitor the number of persons in the private viewing booth at any time.
   J.   The operator of an adult amusement establishment shall, during each business day, regularly inspect the walls between private viewing booths of peep show devices for openings of any kind.
   K.   The operator of an adult amusement establishment shall designate one or more persons to monitor the number of occupants m a booth at least once every thirty minutes. Said monitor(s) shall be on the premises at all times the establishment is open to the public. For purposes of this subsection, monitoring may be accomplished by use of television cameras and monitors that provide an ability and frequency of booth inspection that is equal to or greater than the monitoring that is otherwise required by this subsection.
   L.   The operator of an adult amusement establishment shall initiate and enforce a no loitering policy in private viewing booth areas.
   M.   The operator of an adult amusement establishment shall post conspicuous signs in well lighted entry areas stating all of the following:
      1.   That no loitering is permitted in private viewing booth areas;
      2.   That the occupancy of private viewing booths is limited to one person;
      3.   That sexual contact between two or more persons on the premises is prohibited;
      4.   That the making of openings between private viewing booths is prohibited;
      5.   That violators will be required to leave the premises;
      6.   That violations of paragraphs 2 and 4 of this subsection are unlawful.
   N.   The operator of an adult amusement establishment shall cause all floor coverings in private viewing booths to be non-porous, easily cleanable surfaces, with no rugs or carpeting.
   O.   The operator of an adult amusement establishment shall cause all wall surfaces and seating surfaces in private viewing booths or any area or room providing patron privacy to be constructed of, or permanently covered by, non-porous, easily cleanable material. No wood, plywood, composition board or other porous material shall be used within forty-eight inches of the floor.
   P.   The operator of an adult amusement establishment shall equip the interior premises with lighting fixtures of sufficient intensity to illuminate the interior of the premises to an illumination of not less than one candle foot as measured at the floor level.
   Q.   The operator of an adult amusement establishment shall cause the premises to be clean and sanitary at all times.
   Cleaning procedures shall include:
      1.   The operator shall maintain a regular cleaning schedule, documented by appropriate logs, and shall employ sufficient personnel to assure the establishment is clean;
      2.   The operator shall provide a monitor to check all areas for garbage, trash, body fluids and excrement and to remove and clean all areas with a disinfectant approved by the health officer. All solid waste generated by an adult amusement establishment shall be collected from the premises for disposal at a lawful solid waste disposal facility at least twice each week. Prior to collection solid waste shall be stored in a manner acceptable to the health officer that prevents access by animals or members of the public and which will not facilitate the creation of a health nuisance.
      3.   Thorough cleaning of the entire interior of any area, booth or room providing patron privacy shall be done using a disinfectant approved by the health officer. Cleaning shall include floors, walls, doors, seating, monitors/TVs, windows and other surfaces.
   R.   The operator of an adult amusement establishment shall cause any seating within a private viewing booth to be designed so as to accommodate one person only.
