2.20.070   Meet and confer process for certified law enforcement officers.
   A.   An employee organization representing employees who are deputies and sergeants in the sheriff's department, certified law enforcement officers except lieutenants and captains, may be recognized in the manner set forth in Sections 2.20.020 and 2.20.030 above, as the authorized representative of such deputies and sergeants and certified law enforcement officers except lieutenants and captains.
   B.   Any memorandum of understanding entered into pursuant to Section 2.20.050 above with respect to deputies and sergeants, and county certified law enforcement officers except lieutenants and captains, shall include the sheriff as a party, or the sheriff and the authorized representative for the deputies and sergeants, certified law enforcement officers except lieutenants and captains, may together establish separate procedures to govern the meet and confer process with respect to those terms and conditions of employment that are within the exclusive control of the sheriff as the appointing authority of deputies and sergeants, and certified law enforcement officers, in the sheriff's department.
   C.   Nothing herein shall prevent the sheriff from acting unilaterally in exercising any powers or fulfilling any duties, responsibilities or deadlines conferred upon or imposed upon the sheriff by the law or the Constitution of the state of Arizona.
