A. Delegation. This chapter shall be effective when, and to the extent which, the state delegates task and enforcement responsibility for the Hazardous Waste Management System, A.R.S. Sections 49-921, et seq., as promulgated in A.C.R.R. R18-8-260, et seq., as it applies to generators of hazardous wastes.
B. Registration. Any person, by site, whose act or process produces hazardous waste identified or listed in A.C.R.R. R18-8-261 or whose act first causes a hazardous waste to become subject to regulation shall register with the department as a generator.
C. Exclusions. The registration provisions of this chapter do not apply to:
1. Hazardous waste treatment storage or disposal facilities (TSDF) which have a hazardous waste permit pursuant to A.R.S. Section 49-922;
2. Generators excluded by A.R.S. Section 49-922(E).
