A. No person shall cause, allow or permit to be emitted into the atmosphere from any off-road machinery, visible emissions for any period greater than ten consecutive seconds, the opacity of which exceeds forty percent. Visible emissions when starting cold equipment shall be exempt from this requirement for the first ten minutes.
B. Off-road machinery shall include trucks, graders, scrapers, rollers, locomotives and other construction and mining machinery not normally driven on a completed public roadway.
