Any proposed development, disturbance, or grading within public right-of-way that is located in a floodway fringe shall require a floodplain use permit pursuant to this title. All provisions of this title shall apply to such activities. No uses shall be permitted which the chief engineer determines would adversely affect the function of the public right-of-way, floodplain, or riparian habitat.
