16.24.040   Public right-of-way.
   Any proposed development, disturbance, or grading within public right-of-way that is located in the floodway shall require a floodplain use permit pursuant to this title, except as exempted under Chapter 16.12. All provisions of this title shall apply to such activities. No uses shall be permitted that the chief engineer determines would adversely affect the function of the public right-of-way, floodplain, or riparian habitat.
