(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) Any failure to comply with any provisions of this chapter or the doing of anything prohibited or deemed unlawful by any provision of this chapter shall be deemed a violation of this chapter. Any person or entity who shall violate any provision of this chapter for which the penalty provisions of divisions (C) and (D) below do not apply shall pay $25 for each provision of this chapter which is violated and payable into the General Fund of the town, and each day that a violation continues to occur shall constitute a separate violation. In the event that legal action is necessary to enforce any provision of this chapter or to collect the charge for a violation of this chapter, the town shall be entitled to recover from such persons or entities violating any of the provisions of this chapter, the reasonable attorneys’ fees incurred by the town provided, however, that the penalty and attorneys’ fees for each violation shall not exceed $2,500.

(C) Any person who violates or fails to comply with any of the provisions of §§ 90.02 and 90.03 of this code shall be deemed in violation and shall pay to the town a fine of $25 for each violation, plus the reasonable attorneys’ fees incurred by the town in enforcing and collecting the fine, provided, however, that the fine and attorneys’ fees for each violation shall not exceed $2,500 in amount. Where the violation is continuing, each day that the violation continues is considered a separate violation.

(D) Any person who shall fail to comply with any of the provisions of §§ 90.30 through 90.33 of this code shall pay $25 for each violation. Further, each day that a violation of §§ 90.30 through 90.33 of this code continues to occur shall constitute a separate violation, and each shelter which is in violation of those terms, or is used in violation of those provisions, shall be a separate violation. In the event that legal action is necessary to enforce the provisions of, or to collect license fees provided by §§ 90.30 through 90.33 of this code, the town shall be entitled to recover from such persons violating these provisions, the reasonable attorneys’ fees incurred by the town, provided, however, that for each such violation, the attorneys’ fees and the penalty provided herein shall not exceed $2,500. Owners of animals, by the provisions of the attribution rules herein or otherwise are jointly and severally responsible for any violations of §§ 90.30 through 90.33 of this code in connection with any animals owned by or attributed to them. Fines so collected shall be paid one-half to the town’s General Fund and one-half to the town’s Sewage Fund, and in return, the town’s Sewage Department shall assist in the administration of §§ 90.30 through 90.33 of this code.
