(a) Definitions. As used in this section:
(1) "Bicycle" means a two-wheeled vehicle, propelled by human power, having a tandem arrangement of wheels equipped with tires, either of which is 16 inches or more in diameter.
(2) "Street" means that portion of the street right-of-way upon which the roadway is located, or any street, alley, avenue, road, boulevard, public way or parkway in the Municipality. Such word does not include sidewalks.
(3) "Tandem bicycle" means any bicycle having two or more seats.
(4) "Tricycle" means a three-wheeled vehicle, propelled by human power, having a tandem arrangement of wheels equipped with tires, either of which is 16 inches or more in diameter.

(b) Safety Inspection.
(1) Before the Police Chief or designee issues any license under this section, each bicycle or tricycle of an applicant shall first be inspected by the Police Chief or designee to determine whether or not the bicycle or tricycle is in good working order and whether or not the required equipment is properly installed.
(2) Such safety inspection shall include, but is not limited to, an inspection of lights, reflectors, brakes, wheel alignment, fork alignment, chain and chain guards, tires, fenders, handlebars, handlebar grips and warning devices.
(3) The Police Chief or designee may authorize a recognized organization to participate in the safety inspection of bicycles and tricycles.

(c) License Issuance and Term; Registration Card and Tag.
(1) Upon a determination that a bicycle or tricycle is in good working order and that the required equipment is properly installed, the Police Chief or designee shall issue a license and, at the time of issuance, shall complete a registration card, showing the name, age and address of the applicant, the name and address of the applicant's parents, guardian or custodian, if the applicant is a minor, and the make, manufacturer's number, color and description of the bicycle or tricycle. A copy of such registration card shall be issued to the applicant.
(2) Such license shall be valid for as long as the applicant owns the licensed bicycle or tricycle, unless such license is suspended sooner pursuant to division (g) of this section.
(3) The Police Chief or designee shall provide a tag or decal bearing a distinctive identification and the year of issuance stamped thereon.

(d) Mutilation of Serial Number, Decal or Plate. No person shall willfully or maliciously remove, mutilate or alter the frame or serial number or any other identifying mark of any bicycle or tricycle registered under this section, or any registration certificate, decal or plate issued hereunder.

(e) Traffic Laws Applicable. All ordinances of the City pertaining to traffic control and regulation, which are applicable to bicycles or tricycles, shall apply whenever a bicycle or tricycle is operate on any street or highway or upon any path set aside for the exclusive use of bicycles or tricycles.

(f) Impounding of Vehicle.
(1) Whenever any bicycle or tricycle is operated by any person, including minors under the age of 18 years, in violation of any of the provisions of this section, such bicycle or tricycle may be seized by any police officer and impounded for a period of time not to exceed 30 days, and shall be released upon order of the Chief of Police or designee.
(2) Such bicycle or tricycle so impounded shall be surrendered to the parent or guardian after a full explanation as to the reasons for its impounding and after the violations have been corrected by such parent or guardian. A complete record of all impoundings of such equipment shall be kept by the Police Chief or designee.

(g) Violations; Warnings and License Suspension.
(1) Violations of this section by any minor shall be reported to the Police Chief or designee, who shall maintain a record of such reported violations and whose action as to any of the matters referred to in this section shall be final.
(2) Upon the first reported violation, a warning shall be issued to the minor and to the parents, guardian or person having the care and control of such minor.
(3) Upon the reporting of a second violation within one year of the first reported violation, the Police Chief or designee shall serve notice upon the minor and the parents, guardian or person having control or such minor, to appear at the time set in the notice. If, upon hearing, it is determined by the Police Chief or designee that a violation of this section did occur and that the minor cited was the person responsible for the violation, the Chief or designee may suspend the license granted under this section for a period up to 90 days.
(4) Upon the reporting of a third violation within one year after the first reported violation, the Police Chief or designee shall serve notice upon the minor and the parents, guardian or person having the care and custody of such minor, to appear at the time set in the notice. If, upon hearing, it is determined by the Police Chief or designee that a violation of this section did occur and that the minor cited was the person responsible for the violation, the Chief or designee may suspend the license granted under this section for a period not to exceed one year.

(h) Penalty. Whoever violates any provisions of this section is guilty of a minor misdemeanor.
