1080.03 PROPER DISPOSAL PRACTICES.
   (a)   Containers.
      (1)   It shall be the duty of each householder or commercial establishment within the Municipality to properly store all garbage and rubbish generated on the premises. All garbage and rubbish stored outside a building shall be stored in containers that have a lid sufficient to prevent the escape of noxious odors, and to prevent the escape of debris to surrounding areas. Containers stored outside buildings shall also be strong enough to prevent rats, dogs, cats or other animals from entrance by way of clawing or biting.
      (2)   Containers, such as plastic bags, cardboard or other penetrable materials, may be used for disposal provided they are stored inside a building until the time for proper disposal.
      (3)   Containers shall not be larger than ninety-six gallons nor weigh more than fifty pounds when full, unless collected through an automated collection service.
      (4)   Householders and commercial establishments shall be responsible for the cleanup of garbage and rubbish on the property when containers are upset or bags are torn by animals.
      (5)   Containers shall be kept in a safe and sanitary condition. Containers which have ragged or sharp edges or have holes in them or of a highly unsanitary condition may be refused pickup.
      (6)   Containers shall not be set out to the curb any sooner than the day before collection and emptied containers shall be removed from curbside by midnight of the day of collection, unless there are special circumstances. Such containers, when placed at the curb, shall not be located more than ten feet from the premises' driveway.
      (7)   Containers shall not be stored in any area in front of the premises.
   (b)   Special Handling Requirements. Certain waste products shall be disposed of with special handling. These products are listed below:
      (1)   Flammable or explosive refuse. Highly flammable or explosive materials shall not be placed in containers for regular collection, but shall be disposed of as directed by the Manager, at the expense of the owner or possessor thereof. Ashes shall be cool to the touch before disposal.
      (2)   Tree branches. Tree branches shall be cut into lengths not to exceed four feet and tied into bundles not exceeding two feet in diameter.
      (3)   Commercial or construction materials. Refuse, such as large automobile parts, tree trunks, broken concrete, sod, stone and dirt, shall be considered in excess of normal solid waste and may require special arrangements for pickup by the hauler.
