1060.01 RATES ESTABLISHED; COMPUTATION OF USAGE.
   (a)   Rates. There is hereby established a sewer service charge for the use of and for the service made available by the Municipal sanitary sewer system, which charge shall be based upon the amount of waste flow into the Municipal sewerage system, whether from within or without the Municipality, according to the following schedule:

   (b)   Computation of Usage.
      (1)   For any building, dwelling or other structure connected to the Municipal sanitary sewers and also connected to the Municipal water system, the usage, for the purpose of a determination of the amount of charges due, shall be based upon the water usage as shown by the water meter located upon such premises.
      (2)   Any person, being the owner or occupant of premises not connected to the Municipal water system, shall be required to install, at his or her expense, a water meter, and all water used for domestic, commercial or industrial purposes shall pass through such meter and charges for use of the sanitary sewer shall be based upon such water usage.
      (3)   If any person or occupant of any private dwelling refuses, neglects or fails to install a water meter, then the water and sanitary usage shall be determined on an EDU basis. (See Section 1054.01(a)(16) for the definition of EDU).
      (4)   In those cases in which sanitary sewer customers are served by their own private wells, and in those cases where the private well, because of impurities such as mud or sand, fouls the operation of the water meter which is used in determining the sanitary sewer usage, the Manager shall have the authority to:
         A.   Remove the water meter; and
         B.   Establish a sanitary sewer use rate based upon an estimated average usage. Sanitary sewer customers who do not agree with the established rate shall have the right of appeal to the Service Committee of Council, who shall be the final board of determination.
   (c)   Industrial Users. Service to industrial establishments may be by contract if the Municipality deems this to be in its best interest. However, in the absence of a contract, charges shall be made in accordance with Chapter 1062.
   (d)   Measurement of Volume. The volume of sewage measured for payment for each account shall be as follows:
      (1)   When the user is supplied with water from the Municipal water system, the quantity of water measured for payment shall also be the quantity of sewage measured for payment.
      (2)   When the user is supplied with water from the Municipal water system and only part of the water enters the sewer system, the Manager may require or permit the installation of an additional meter to measure the quantity of sewage actually entering the sewer system. The meters shall be approved by the Manager and furnished, installed and maintained at the expense of the user.
      (3)   When the user is supplied with water, in part or in total, from a source other than the Municipal water system, the Manager shall require the installation of meters to measure the supply of water from all sources or to measure the volume of sewage entering the sewer system. The meters shall be approved by the Manager and furnished, installed and maintained at the expense of the user.
      (4)   All sewage entering the sewer system shall be measured for payment. All meters required under this section shall be furnished and installed at the expense of the user. All defective meters shall be replaced at the expense of the user.
      (5)   The Manager may require from the user that the Municipality be furnished, upon request, with information and data on all sources of water within the confines of the premises which may enter the sewer system.
