(a) Any person who violates, neglects, refuses to comply with, or assists or participates in any way in violation of any of the provisions or requirements of this chapter or of any of the provisions or requirements of any sexually oriented business establishment registration, shall be deemed guilty of a misdemeanor of the fourth degree. The penalty upon conviction of such person shall be imprisonment for a period not to exceed 30 days and/or a fine not exceeding two hundred and fifty dollars ($250.00).
(b) Each day such violation continues shall constitute a separate offense. The City Manager, or his or her designee, shall cause written notice to be given to any such person of any such violation and the penalty and fine therefore by serving a citation in person or by certified United States mail, postage prepaid, return receipt requested, addressed to the registrant's address as set forth in the registrant's application.
