648.12 CIVIL EMERGENCIES.
   (a)   Proclamation of State of Emergency.
      (1)   When a civil emergency occurs, such as a tumult, riot, mob or a body of people acting together with the intent to commit or facilitate the commission of a felony or a misdemeanor, to do or offer violence to person or property or, by force and violence, to break or resist the law, or, in the event of a flood, fire, snowstorm or any other public crisis or disaster, either natural or man-made, affecting life and property and substantially impairing the functioning of the Village government and its ability to protect the lives and property of the people, any of the following named officers of the Village, acting in the order herein designated, when the previously named officers are absent from the Village or are unavailable or incapable of doing so, are hereby authorized and directed to proclaim the existence of a state of civil emergency in the Village or within any prescribed area thereof:
         A.   The Mayor;
         B.   The President Pro-Tempore of Council;
         C.   The Vice President Pro-Tempore of Council;
         D.   The Village Manager;
         E.   The Assistant to the Village Manager;
         F.   The Chief of Police; or
         G.   The Law Director.
      (2)   No person shall violate any proclamation issued in accordance with this section.
   (b)   Proclamations to Protect Life and Property. When a state of civil emergency has been proclaimed in accordance with division (a) of this section, any officer named therein who is acting in the order designated is hereby authorized and directed to issue such proclamations as he or she deems necessary to protect life and property. Such proclamations may include, but are not limited to:
      (1)   The establishment of a curfew;
      (2)   The prohibition of the sale of beer or intoxicating liquor;
      (3)   The prohibition of the sale of firearms and explosives or of gasoline or other such combustible liquids in cans or portable containers;
      (4)   The restriction or prohibition of movement into, out of or within the affected area; and
      (5)   The prohibition or limitation of the assemblage of persons.
   (c)   Obedience to Lawful Orders; Interference. No person shall fail to obey the lawful order of any police officer, militiaman or other law enforcement officer, and no person shall, in any way, intentionally interfere with any police officer, militiaman or other law enforcement officer or firefighter, other authorized person or authorized rescue personnel, in the protection or preservation of life or property during the existence or a state of civil emergency if such state is proclaimed as provided in division (a) of this section.
   (d)   Termination of Emergency. When, in the judgment of the proclaiming authority, conditions return to a state of normalcy and the situation so warrants, he or she shall issue a proclamation ending the state of civil emergency, and any proclamation, order or regulation issued pursuant to division (a) of this section shall become void.
   (e)   Penalty. Whoever violates this section is guilty of a misdemeanor of the first degree.
