(A) A zoning/construction permit must be issued prior to any work starting and must be done in accordance with the plan specifications, maps and local ordinances and must be approved by Zoning Administrator and Village DPW Superintendent. Applicant will be responsible for completion of all items of construction set forth in the construction permit prior to the expiration date on the permit. Once completed, the applicant will be responsible for notifying the Village DPW Superintendent so that a compliance inspection can be scheduled.
(B) (1) Permit must be approved before work commences. The permit must be on-site during construction.
(2) Permits will be issued at no charge to property owner.
(3) The permit holder under this permit shall be required to work in a safe manner, furnish, install and maintain all necessary traffic controls and protection during construction in accordance with the Michigan Manual of Uniform Traffic Control Devices and to keep the area affected by this permit in a safe condition (any damages or debris drug into the shoulder or roadway must be repaired or removed promptly by applicant) until work is completed as deemed necessary by the Village DPW.
(4) The Village DPW reserves the right to halt any and all activities in the case of a permit violation, revocation or failure to obtain an appropriate permit.
(5) The permit may be suspended or revoked for failure to comply with permit, local or safety requirements, and the permit holder shall surrender and alter, relocate or remove its facilities at its expense, following the request of the Village DPW.
(6) This permit does not relieve permit holder from meeting other applicable laws and regulations of other agencies. The permit holder is responsible for obtaining additional permits or releases, which may be required in connection with this work from other government agencies, public utilities, including property owners. Permission may be required from the adjoining property owners.
(7) The period applied for and granted in this application and permit covers activity within the right-of-way. Failure of the permit holder to finish work with one year from date of issuance shall cancel this permit.
(8) The permit holder must comply with the requirements of Public Act 53 of 1974 as amended, being M.C.L.A. §§ 460.701 to 460.718 (call Miss Dig), at least three full working days, but not more than 21 calendar days, before he or she starts work.
(9) Changes in the driveway surface (graveled to paved or concrete) shall require the property owner to obtain a new permit.
(10) All portions of a residential driveway shall be located entirely within the applicant’s property line and must extend a minimum of 25 feet from the property line into the applicant’s property.
(11) No portion of the driveway entrance within the road right-of-way or a minimum of ten feet from the edge of the road shall have a grade greater than one foot vertical in ten feet horizontal.
(12) No portion of a residential driveway shall be located closer than 50 feet to the nearest right-of way line of an intersecting roadway.
(13) All drives shall enter perpendicular to the existing roadway.
(14) All driveways will be at a minimum of 12 feet wide and maximum of 24 feet wide. At minimum driveways shall be surfaced with least six inches of gravel and have the same slope as the roadway for at least ten feet from the edge of the traveled roadway.
(15) Open pavement cuts for the placement of new utilities; tile drains and the like will not be permitted unless approved by the Village DPW and will also determine as how the pavement will be replaced.
(16) Driveways will be inspected by the Village DPW to determine if culverts and/or ditching are required. The work will be at the property owner’s expense and may be done by the owner or private contractor. Culverts shall be no less than 12-inch diameter installed in line with the road ditch. Culvert headwalls will not be permitted, but end sections will be allowed.
(17) Commercial drives may require concrete curb and gutter and will paved with bituminous or concrete to the right-of-way line.
(18) All backfill within the influence of the roadway curb and gutter or shoulder edge shall be placed and compacted according to current MDOT specifications. Density testing will be required
(19) The property owner shall maintain brush cutting and clear vision along the property owner’s frontage.
(20) When the permit work is completed, the property owner shall notify the Village DPW so work can be inspected and given final approval for work done.
(21) The village will be responsible for maintenance and replacement of existing and approved installations of driveway culverts.
