§ 91.01 IMPROPER DISPOSAL OF WASTE.
   (A)   (1)   Any person who deposits, throws, discards, or otherwise disposes of any material other than those specifically approved and listed here in the areas designated by the village for disposal of grass, trees, and white goods shall be guilty of a misdemeanor and subject to a fine of not less than $100 nor more than $500 per instance.
      (2)   Said person will also be responsible for payment of fines or other civil damages that may be incurred against the village, as well as any other consequential damages of such action.
   (B)   Approved materials for each respective area shall be limited to the following.
      (1)   The Grass Area shall be limited to grass, weeds, brush, and other plant material.
      (2)   The Tree Area shall be limited to trees, leaves, and other parts or byproducts of trees not specifically exempted.
      (3)   The White Goods Area shall be limited to discarded refrigerators, ranges, water heaters, freezers, air conditioners, humidifiers, and other similar domestic and commercial large appliances.
   (C)   Under no circumstances shall lumber with nails or treated lumber be deposited in any of the areas listed in division (B) above. TREATED LUMBER shall be defined, for the purposes of this section, as wood material that has been changed or altered through a chemical process which contain paint, resin, preservatives, or other similar substances. Examples of which include, but are not limited to, the following:
      (1)   Painted lumber wood siding (e.g., from a house or other building, fence, or interior house trim);
      (2)   Glued particleboard or plywood (e.g., cabinets or flooring);
      (3)   Creosoted wood (e.g., railroad ties, telephone poles, bridge planks, or fence posts);
      (4)   Stained wood (e.g., flooring, doors, trim, cabinets, or decking); and
      (5)   Wood preserved with fungicide or pesticide (e.g., shingles, siding, or decking).
