(A) Miami County has a solid waste service board which is mandated by state law and which is responsible for services such as recycling, hazardous waste removal, large item removal and other such solid waste services. The functions of the solid waste board are funded entirely by service fees and are not a part of the municipal services of the city. City and county residents all pay solid waste user fees, which pays for these services.
(B) The city also pays for the services of a landfill as a municipal service for disposal of collected trash. The landfill accepts the trash collected from local households, but the landfill is not owned by the city. The fees for this landfill service are paid through the property tax system of the city, therefore, this municipal service is affected by annexation. The fees associated with the operation of the landfill are outside of the authority of the municipality and may be adjusted from time to time by the landfill owner. The municipality retains the right to adjust any and all charges and fees associated with such operations and/or services related hereto, however, at this time the city uses property tax revenue streams to pay for these landfill services.
