(A) For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
MOTORIZED VEHICLE. Any two-wheeled or three-wheeled device that has handlebars, is designed to be stood upon or seated upon by the operator, and any four-wheeled device which is not required to have a license plate under the rules and regulations set forth by the Indiana Bureau of Motor Vehicles, and is powered by a motor, gasoline, ethanol, diesel, electric, solar or any combination thereof, that is capable of propelling the device with or without human propulsion at a speed of more than 15 miles per hour.
POCKET BIKE. Any wheeled device ridden by a person or used as transportation, powered or assisted by any on-board power source, gasoline, ethanol, diesel, electric, solar or any combination thereof, other than the rider's own physical efforts that has a handlebar height of 30 inches or less, measured from the highest point of the handlebar or a seat height of 24 inches or less, as measured from the highest point of the horizontal seat surface actually designed to bear the weight of the rider.
(B) Any additions or modifications to these devices will not alter its basic nature and will not render the provisions of this subchapter inapplicable.
(C) These definitions shall not be interpreted to include any device designed for use as transportation by a person with physical disabilities, and which is actually used for that purpose.
