(a) No person shall drive or operate or cause to be driven or operated any commercial vehicle, trailer or semi-trailer, which is equipped with a special brake or retarder brake in such a manner that the use of said brakes creates excessive or unreasonable noise or exhaust (black smoke) which is offensive to any person located beyond the road right of way.
(b) Whoever violates this section shall be guilty of a minor misdemeanor. Any subsequent offense within a one year period shall be a misdemeanor of the fourth degree.
