937.01 INDUSTRIAL COST RECOVERY.
   (a)   In order to comply with U.S. Environmental Protection Agency rules and regulations for Treatment Works Construction Grants, Federal, Register, Volume 38, No. 161, the Village of Perrysville should establish an industrial cost recovery system to recover from industrial users, as defined in 40 CFR 35.905-8, that portion of the grant amount allocable to the treatment of wastes from such users. However, at the present time, there are no industrial users served by the wastewater facilities of the Village that discharge or are expected to discharge in the future, anything to the sewer system that is other than non-process segregated domestic wastewater or wastewater from sanitary conveniences.
   (b)   The Village will not require any existing industries discharging to the sewer system to repay that portion of the grant allocable to the treatment of their wastes. If, at any time in the future, an industry or industries do discharge such wastewater as described above, then the Village will design and implement a satisfactory industrial cost recovery system, according to the U.S. EPA regulations concerning such systems. Also, the user charge system will be revised to add a third user class, the “Industrial” class, if such industrial wastewater is discharged.
