1086.05 COLLECTION PRACTICES.
   (a)   Subsection (a) hereof was repealed by Ordinance 94-85, passed October 15, 1985.
   (b)   Subsection (b) hereof was repealed by Ordinance 94-85, passed October 15, 1985.
   (c)   Collection by Actual Producers and Outside Collectors; Roll-Offs/Dumpsters.
      (1)   Requirements for vehicles. The actual producers of refuse, or the owners of premises upon which refuse is accumulated, who desire personally to collect and dispose of such refuse, or persons who desire to dispose of waste material not included in the definition of refuse, and collectors of refuse from outside the City who desire to haul over the streets of the City, shall use a watertight vehicle provided with a tight cover and so operated as to prevent offensive odors escaping therefrom and refuse from being blown, dripped or spilled.
      (2)   Disposal. Disposal of refuse by persons under subparagraph (c) (1) hereof shall be made outside the City limits, unless otherwise directed by the Director.
      (3)   Rules and regulations. The Director shall have the authority to make such other reasonable regulations concerning individual collection and disposal and relating to the hauling of refuse over City streets by outside collectors as he finds necessary. Any such additional regulations shall be published by the City, in the manner specified in Charter Article III Section 12.0(A).
      (4)   Licensing haulers. No person, firm or corporation shall engage in the business of collecting, hauling and/or disposing of any refuse within the City limits unless he first obtains a license therefore from the Director. The fee for any such license shall be fifteen dollars ($15.00) per year per vehicle. All licenses shall expire on December 31 of the year of issue.
         A.   This section shall not apply to any private individual hauling refuse from his own premises, nor to the City or any person who has contracted with the City to provide such services.
         B.   A condition of any license issued shall be that the licensee agrees to collect, transport and dispose of any refuse in a sanitary manner so as not to create a nuisance.
         C.   Roll Offs/Dumpsters may be placed in the public right-of-way with permission from the Director. The homeowner is responsible to secure a Street, Alley or Public Way Opening Application and Permit and pay the fees ($100.00 deposit - to be returned if no damage is done to City property and $10.00 processing fee) prior to placement.
