1026.01 TRIMMING OF GROUND COVER VEGETATION.
   (a)    Every owner of a lot or parcel of land in the City shall maintain the public right of way adjoining such lot or parcel in a neatly trimmed manner. The ground cover vegetation shall be considered to be neatly trimmed if it is cut at least monthly during the growing season.
   (b)    Cuttings described in subsection (a) hereof shall be performed by the City for public right of ways adjoining lots or parcels of land being used for agricultural purposes, and for limited access right of ways. (Ord. 100-86. Passed 9-16-86.)
   (c)    The Mayor shall cause a general notice to be published advising the owners or persons having charge of parcels of land in the City that adjoining rights-of-way must be cut not less than five days after the publication of such notice. If the published notice is not complied with, the Mayor shall direct the Director of Public Service to undertake the immediate cutting of such rights-of-way and to certify the cost of labor and materials in connection therewith, per lot, to the Finance Director. The Finance Director shall bill the owner or person having charge of such land and the actual cost of the cutting, as certified to him or her, and shall take all necessary steps to collect the same.    (d)    Upon failure of the lot owner to pay the costs involved, the Finance Director shall certify the costs to the County Auditor, which costs shall be entered on the tax duplicate for collection and upon collection shall be credited to the General Fund.

   (e)   A minimum charge of one hundred dollars ($100.00) shall be made against the owner of a lot mowed or cleaned of litter and debris by the City under subsection (a) and (d) hereof, for one hour or part thereof. Each additional hour or any part thereof shall be charged at the rate of seventy-five dollars ($75.00) per hour.
