(a) Whenever any gas, steam power, telephone, telegraph, water or electric light company or other person makes or causes to be made any excavation in any paved street for the purpose of laying down its pipes or wires, or for any other purpose, they shall, without delay, fill the excavation caused by removing the earth in making the ditches, with berm stone No. 411, free from earth or other impurities, or with such other materials as directed by the Director of Public Service-Safety, and replace all other materials which they have removed or may remove or disturb in making such excavations, so that the streets are restored to as good and permanent a condition as the same were before the excavation was made or materials removed. In no case shall the company or other person have more than 330 feet of ditch open at any one street at any one time. Before breaking ground on more than 330 feet, they shall fully reinstate and repair all other portions of the street which they have disturbed. In case such company or other person refuses or neglects to comply with this section, the Director of Public Service-Safety shall cause the ditches to be filled and the street repaired and shall collect the cost of such filling and repair by a civil action in any court having jurisdiction.
(b) Backfill shall be placed in lifts no greater than three feet in depth, if a mechanical compactor is used. The maximum lift with hand compaction shall be four inches.
(c) When an opening cannot be backfilled prior to 4:15 p. m., steel plates shall be placed over the opening to eliminate traffic obstructions during rush hours.
(d) Repaving shall be started promptly upon completion of backfilling.
(e) Whenever any gas, steam power, telephone, telegraph, water or electric light company or other person makes or causes to be made any excavation in any tree lawn for the purpose of laying down their pipes or wires, or for any other purpose, they shall, within thirty days, fill the excavation caused by removing the earth in making the ditches, with berm stone No. 411, free from earth or other impurities, or with such other materials as directed by the Director, and replace all other materials which they have removed or may remove or disturb in making such excavations, so that the tree lawns are backfilled, tamped or jetted, with sod to be put in place, so that such treelawns are restored to as good and permanent a condition as the same were before the excavation was made or materials removed. In no case shall the company or other person have more than 330 feet of ditch open on any treelawn at any one time. Before breaking ground on more than 330 feet, they shall fully reinstate and repair all other portions of the treelawn which they have disturbed. In case such company or other person refuses or neglects to comply with this section, the Director shall cause the ditches to be filled and the treelawn repaired and shall collect the cost of such filling and repair by a civil action in any court having jurisdiction.
