(a) There are two (2) basic types of subdivisions:
(1) Minor subdivision. The Perry Village Planning Commission, through a designated representative, may determine that a proposed subdivision of land is a minor subdivision if the proposed division of a parcel of land is along an existing public street, and does not involve the opening, widening, or extension of any street or road, does not involve more than five (5) lots after the original tract has been completely subdivided, and is not contrary to applicable zoning regulations or applicable subdivision regulations.
(2) Major subdivision. Any proposed subdivision that does not meet the requirements of a minor subdivision and including the improvement of parcels of land for residential, commercial, or industrial structures or groups of structures which may or may not be ultimately jointly-owned under a recorded condominium property declaration. Condominium subdivision shall cease to be subject to these regulations at such time that an appropriate condominium declaration has been prepared for the property as already improved under these regulations and said declaration is in the process of submission for recording under the provisions of Chapter 5311 of the Ohio Revised Code.
(b) Land Contract. The transfer of ownership of a parcel or parcels of land by Land Installment Contract (Land Contract) shall not exempt a developer from the requirements of subdivision plat approval as specified in these Regulations.
