(A) Home rule. The State Home Rule Act, I.C. 36-1-3 et seq., gives the Commissioners all powers needed for the effective operation of government as to local affairs. The Act gives the Commissioners all powers granted to them by statute and all other powers necessary or desirable in the conduct of its affairs, even though not granted by statute. Further, I.C. 36-l-3-6(a) provides that if there is a constitutional or statutory provision requiring a specific manner for exercising a power, a unit wanting to exercise the power must do so in that manner, and that in the absence of a constitutional or statutory provision requiring a specific manner for exercising a power, a unit wanting to exercise the power must either:
(1) Comply with a statutory provision permitting a specific manner for exercising the power; or
(2) Adopt an ordinance prescribing a specific manner for exercising the power.
(B) Police powers. Indiana counties possess broad police powers to protect the public health, safety, welfare and economic well being of county residents.
