§ 153.33 VARIATIONS.
   (A)   The provisions of this chapter may upon application be varied by the Board of Trustees in specific cases when, in the Board’s opinion, the variation is necessary to the economic viability of a desirable land use, or does not materially affect the spirit of this chapter. The fee for a variance application is $100.
   (B)   Variations shall be valid only for the land use for which they were originally granted. If a use is abandoned or changed, the variation shall lapse unless the Village Board, on application of the new owner, shall vote to extend the variation.
   (C)   If a variation shall lapse, the sign shall be removed within 30 days, and if not so removed, the village shall have the right, as a condition to the variation, to go upon the land where the sign is located and remove such sign.
