§ 112.19 LIMITATIONS ON LICENSES.
   (A)   Number of licenses; increase and decrease.
      (1)   The Board of Trustees shall determine, by ordinance, the number of licenses other than C-2 licenses that are available in each classification. A liquor license may be issued to an applicant by the local Liquor Control Commissioner only after such license has been created by the Board of Trustees. Not more than one of said licenses shall be issued for the county fairgrounds. Neither the Commissioner nor any other person or entity may issue liquor licenses in a number that is in excess of the number authorized for each classification by the Board of Trustees. An up-to-date schedule of the authorized number of licenses available in each classification shall be maintained by, and available from, the Village Clerk. When a liquor license expires and is not renewed or is revoked or terminated, the number of authorized licenses in a particular class shall automatically be reduced by the total number of non-renewed, revoked or terminated licenses. The local Liquor Control Commissioner shall notify, in writing, the Village Clerk and Board of Trustees of the revocation or termination of any authorized license within 30 days of such occurrence.
      (2)   No licenses shall be issued in excess of the above-indicated number of licenses per class, except that Class C-2 licenses may be issued at the discretion of the Liquor Control Commissioner subject to division (B) below.
   (B)   Application for a Class C-2 license shall be made to the Liquor Control Commissioner at least one week prior to the day on which said license is to take effect. Every application for said Class C-2 license shall be accompanied by a certificate of insurance written by a responsible insurance company authorized and licensed to do business in Illinois, at a minimum insuring the applicant against liability to the limits provided in the Liquor Control Act of the State of Illinois, ILCS Ch. 235, Act 5, § 1 et seq.

   (C)   Cessation of business. When a licensed establishment, for a period of 30 continuous days, ceases to dispense alcoholic liquors or to engage in some other activity required for that class of liquor license, that license shall automatically terminate and the number of licenses available in that class shall immediately and automatically be reduced by one. For purposes of this division, CEASES TO DISPENSE ALCOHOLIC BEVERAGES shall mean any failure to make alcoholic liquor of the kind permitted by the specific license available to the public at the licensed premises. This shall include failure for any reason, except for periods during which the liquor license of the premises was suspended for cause by order of the local Liquor Control Commissioner of the village, or periods during which service is suspended due to a state or local public health emergency or, following written notice to the local Liquor Control Commissioner in advance of the closing, the closing of the premises for remodeling or repairs for which proper permits have been obtained and work is taking place, or for some other similar approved purpose.
