§ 94.99 PENALTY.
   (A)   Any person, firm, or corporation violating any provision of this chapter or violating any of the reasonable rules of the Health Inspector with regard to quarantined premises, or disturbing or disregarding any notice of quarantine placed by or under the direction of the Health Inspector shall be fined not less than $25 nor more than $750 for each offense. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
   (B)   Except when fines and costs are paid by compromise payment as provided in division (C) below prior to court, the Circuit Clerk shall add to the fine any and all costs and fees upon an authorized disposition. A separate offense shall be deemed committed for each day during or on which a violation occurs or continues.
   (C)   A person who smokes in an area where smoking is prohibited under § 94.47 shall be fined in an amount that is not less than $100 and not more than $250. A person who owns, operates, or otherwise controls a public place or place of employment that violates § 94.47 shall be fined (i) not less than $250 for the first violation, (ii) not less than $500 for the second violation within one year after the first violation, and (iii) not less than $2,500 for each additional violation within one year after the first violation.
   (D)   Compromise payment. In the event the Peotone Police, the Village Code Enforcement Officer or other designee of the village elect to charge any individual under a compromise citation as set forth hereinafter, any such person accused of a violation of this chapter and originally charged under this section may settle and compromise the claim without a court appearance by payment of one-half of the minimum required fine to the Village Clerk of the Village Hall within ten business days of the date of the violation if the compromise box designation is so checked on the Complaint and Notice to Appear form.
