§ 91.43 CONFINEMENT OF BITING ANIMALS; PROCEDURE.
   (A)   It shall be unlawful for the owner of any dog, or other animal, when notified by the Police Department or Health Inspector that such dog or other animal has bitten any person, to sell or give away such dog or other animal or to permit or allow such dog, or other animal, to be taken beyond the limits of the village. It shall be the duty of such owner of a biting animal, upon receiving notice from the Police Department or Health Inspector to deliver said dog, or other animal within 24 hours to a licensed veterinarian for confinement and observation, at the expense of the owner, for a period of ten days. The veterinarian confining and observing the biting dog or other animal, shall report immediately by telephone, in person, or by other than use of the mail, and shall confirm in writing to the Police Department or Health Inspector within 24 hours after the dog or other animal is presented for confinement and observation, the clinical condition of the dog or other animal; the owner's name, address, and the date of confinement; the breed, description, age, and sex of the dog, or other animal on forms provided by the village. Within 24 hours after the end of the confinement and observation period, the licensed veterinarian shall submit a written report to the Police Chief or Health Inspector advising him of the final disposition of such dog or other animal on forms provided by the village.
   (B)   (1)   If however, the dog or other animal is examined by a licensed veterinarian within 24 hours after notifications by the Police Department or Health Inspector and found to be free of signs of rabies and the examining veterinarian has presented evidence that such dog or other animal has been inoculated against rabies more than 30 days prior to the biting and less than one year if a one- year immunity vaccine is used, or less than three years if a three-year immunity vaccine is used and the bite occurred below the shoulder of the bitten person, home confinement of the biting dog or other animal for the ten-day period may be allowed by the Administrator upon the recommendation of the examining veterinarian provided the dog or other animal is confined in the house of its owner; and in a manner that will prohibit such dog or other animal from escaping and from biting any person or animal for the ten-day period. Should the animal become ill, die, or escape during the ten-day period, the owner shall immediately notify the Police Department or Health Inspector.
      (2)   At the end of the ten-day confinement period, the owner shall present the dog or other animal for re-examination by the examining veterinarian. If the dog or other animal is confined as described in this division, the examining veterinarian shall report to the Police Department or Health Inspector the clinical condition of the dog or other animal immediately, by telephone, in person, or by other than the use of the mail, as described in division (A) of this section, with subsequent written reports within 24 hours of the beginning of confinement and 24 hours after the completion of confinement. If the owner fails to present the dog or other animal for re-examination by the examining veterinarian within 24 hours of the completion of the ten-day confinement period, the examining veterinarian shall notify the Police Department or Health Inspector of this fact immediately, by telephone, in person, or by other than use of the mail.
   (C)   If the dog or other animal escapes from the house of its owner during the ten-day home confinement period or if the owner fails to deliver the dog, or other animal to a licensed veterinarian for re-examination within 24 hours of the completion of the ten-day confinement period, the owner is hereby declared to be in violation of this section and is subject to the penalties provided elsewhere in this chapter. In addition, the owner of an escaped dog or other animal shall immediately apprehend it and deliver it to a licensed veterinarian for confinement, at the owner's expense, for the remainder of the ten-day period.
   (D)   In those cases where the owner or keeper of a dog or other animal which has bitten any person, refuses to deliver said dog or other animal within 24 hours after receiving notice from the Police Department or Health Inspector to a licensed veterinarian of their choice for confinement and observation, the Animal Control Officer is authorized to seize and impound at a veterinary hospital said dog, or other animal for a period of ten days at the expense of the owner. The biting animal shall not be released by the Animal Control Officer until all costs of seizure, examination, confinement, observation, notification, and inoculation has been paid by the owner or keeper of said dog or other animal.
   (E)   The owner of a dog four months of age or older, not currently inoculated against rabies, as provided elsewhere in this chapter, must have the dog inoculated against rabies at the time of release from confinement.
   (F)   All costs of examination, confinement, observation, notification, and inoculation shall be borne by the owner of the dog or other animal.
