§ 91.02 RUNNING AT LARGE.
   (A)   No owner of a dog or other animal shall cause or permit such dog or other animal to run at large at any time in any area of the village. All dogs and other animals kept within any area of the village shall be kept under control of the owner thereof and shall be confined by means of a secure leash or chain, or confined within a fenced area in such a manner as to prevent the dog or other animal from running at large. No one shall walk or otherwise exercise their dog or other animal outside of a fenced-in area without controlling the dog by means of a secure leash or chain. Any dog or other animal found in violation hereof is hereby declared to be a public nuisance and shall be apprehended and impounded in the manner provided in this chapter.
      (1)   Persons who utilize “invisible fencing” to contain any animal must prominently display on their property immediately adjacent to the public sidewalk or, absent a public sidewalk the public right-of-way, a sign which indicates that any animal located thereon is contained by way of “invisible fencing”.
      (2)   Invisible fencing is not required to extend to the property lines of the lot.
      (3)   In residential districts, invisible fencing installed after April 30, 2013 shall be located so as to prevent the animal from entering the area between the street and a plane described by the wall of the house or garage.
      (4)   The installation of invisible fencing shall require a building permit pursuant to the Peotone Building Code.
   (B)   However, if such dog or other animal cannot be safely taken up and impounded, such dog or other animal may be destroyed by the Animal Control Officer; provided that in all cases where such dog or other animal has bitten or caused an abrasion of the skin of a person, is so slain and a period of less than ten days has elapsed since the day upon which such dog or other animal bit or caused abrasion of the skin of any person, it shall be the duty of the person destroying such dog or other animal to deliver the head and the brain of such dog or other animal to the Animal Control Officer immediately after such destruction.
   (C)   Notwithstanding any other fine established for any other sections of this chapter, the fine for violation of division (A) of this section shall be $25 for a first offense, $50 for a second offense, and not less than $75 nor more than $750 for a third offense and subsequent offenses.
