§ 98.06 SPACING.
   Except as may otherwise be specifically provided for in any annexation or development agreement approved by the Village Board, the following rules shall apply:
   (A)   Street trees shall be planted along all public or privately dedicated streets within the existing village or new development at a rate of one tree per 35 lineal feet, (excluding driveways) or fraction thereof.
   (B)   No street tree shall be planted closer than 35 feet from the right-of-way line at an intersection or closer than eight feet from any drive or alley way.
   (C)   Trees and shrubs shall not be located closer than 15 feet to fire hydrants, transformers, public works utilities or street light.
   (D)   Parkways shall be planted in grass or low ground cover, except where covered by trees or up to two feet of pavement which is allowed along the street curb (for a maximum of 15 linear feet per lot.). As no parking is allowed on parkways, the use of stone, rock, gravel or any other paving materials is prohibited on public parkways.
   (E)   If overhead utilities exist, tree selection shall be made from the approved small tree list and spacing shall be reduced to one tree per 25 linear feet.
   (F)   No tree shall be planted closer to any curb or sidewalk than the following:
      (1)   Small trees, 2 feet;
      (2)   Large trees, 4 feet.
   (G)   Parkways less than four feet in width do not require tree plantings.
   (H)   All trees and shrubs planted shall be placed subject to the directions and approval of the Director of Public Services.
