6-6-3: DISORDERLY CONDUCT 1 :
A person commits disorderly conduct when he/she knowingly:
   A.   Does any act in such an unreasonable manner as to alarm or disturb another and to provoke a breach of the peace; or
   B.   Through any utterance, gesture, or display, creates a clear and present danger of a breach of the peace or imminent threat of violence; or
   C.   With intent to harass, annoy or intimidate another, makes a telephone call, whether or not conversation thereby ensues. This subsection includes collection agencies or employees thereof as defined in the state collection agency act; or
   D.   Transmits in any manner, to any person or agency, a report of a fire, bomb, natural disaster, crime in progress, accident, sick or injured person, or any other emergency situation knowing at the time of such transmission that there is no reasonable ground to believe that such a condition exists; or
   E.   Transmits in any manner to any police officer, public officer, or public employee a report to the effect that an offense has been committed, knowing at the time of such transmission that there is no reasonable ground to believe that such an offense has been committed; or
   F.   Refuses or fails to cease and desist any peaceful conduct or activity which is likely to produce a breach of the peace after being ordered to do so by a police officer or any official with the authority to make such an order; or
   G.   Obstructs or interferes with the performance of any police officer, firefighter, emergency medical technician, public utility worker, street construction worker, or other person or agency while engaged in service to public safety, public infrastructure, or public or privately owned utilities; or
   H.   Enters upon the property of another and, for a lewd or unlawful purpose, deliberately looks into a dwelling on the property through any window or other opening; or
   I.   As the operator of a motor vehicle, causes any stone, dirt, gravel, or other object to be heedlessly hurled or discharged by rapid acceleration or spinning of tires on any public street or highway in the village; or
   J.   Urinates, defecates, or causes any human or animal waste to be placed or discarded upon any public street, alley, sidewalk, or any part of any public building, or of any building or grounds where the public gathers or has access to, or in any other place, whether public or private, where such act could be observed by any member of the public, except in such place that has been designated as a restroom when fixtures provided for such purpose are properly utilized; or
   K.   Initiates, engages in, simulates, encourages or promotes any fight or physical altercation between two (2) or more individuals on any public property, or private property where any member of the public could reasonably view such altercation, regardless of whether any person involved in such altercation desires or declines criminal prosecution. Exemptions shall include properly sanctioned and comported sports events and self-defense as allowed pursuant to Illinois law; or
   L.   Utters profane, obscene or abusive words or performs profane, obscene or abusive acts or gestures directed to or within the view or hearing of another, with the intent to provoke a breach of the peace; or (Ord. 2006-1259, 2-21-2006)
   M.   Yells, shouts, whistles or activates a horn, other than the use of a motor vehicle horn used only as a warning for safety purposes, or other unnecessary noise or light producing device or object, or creates an unnecessary commotion of any type between the hours of eleven o'clock (11:00) P.M. and six o'clock (6:00) A.M. the following day; or (Ord. 2006-1259, 2-21-2006; amd. 2016 Code)
   N.   Becomes intoxicated to the degree as to be a danger to personal or public safety by staggering, falling, lying, sitting or obstructing in any manner a street, sidewalk, railroad track or any public way; or
   O.   Disturbs any passerby or disrupts lawful orderly public assembly upon any street, sidewalk or other place open to the public by placing obstructions upon or across the same, by throwing objects of any kind or by jeering or deriding any person in any manner, with intent to disturb any person or disrupt any lawful assembly; or
   P.   Causes or permits any room, house, shop, building, or place of any description to become the gathering place of disorderly persons, causes or permits any unreasonable noise, or causes or permits criminal acts of any type. No person owning or in possession, charge or control of such premises shall permit the disturbance, disruption, or destruction of the peace of the neighborhood in which such building or premises is situated. Three (3) violations of this subsection within a twelve (12) month period shall be grounds for the village to declare such premises a public nuisance; or
   Q.   Intentionally engages in any act of nudity whereby the genitals, buttocks, anus, or female breast below the top of the areola is exposed, when the person performing such act knows or should reasonably know that he/she is within the view of the public, or performs any lewd exposure of the body or fondling or caressing of the body with the intent to arouse or satisfy the sexual desire of another; or
   R.   Engages in or simulates any sex act when the person performing such act knows or should reasonably know that he/she is within the view of the public; or
   S.   Displays, exhibits or distributes any material in any form that is considered obscene or offensive (when considered as a whole by the average person applying contemporary community standards), or that a minor would otherwise be protected from viewing or listening to by existing law, when that person knows or should reasonably know that the material is within view of the public.
