§ 50.136 APPLICATION FOR PERMIT TO DISCHARGE.
   (A)   All industrial users, regardless of classification, and who are seeking service or seeking renewal of existing permits, shall submit an application for permit to discharge to the town. Application forms shall be supplied by the town. All applications submitted to the town shall be accompanied by the required application fee. applications not accompanied by the application fee will not be processed.
   (B)   Applications submitted to the town shall include the following information:
      (1)   Name, mailing address, and street address (if different from mailing address);
      (2)   Name of the operator and owner;
      (3)   Industrial category description, NAICS numbers, and SIC number(s);
      (4)   Telephone, telefax number(s), and email addresses;
      (5)   A general description of the industrial operation, its finished products, number of employees, working hours, number of shifts, etc.
      (6)   Description of activities, facilities, and plant production processes on the premises;
      (7)   A list of any environmental control permits held by or for the facility;
      (8)   Description of operations.
         (a)   A brief description of the nature, average rate of production (including each product produced by type, amount, processes, and rate of production, and SIC and NAICS numbers for the facility. This description should include a schematic process diagram, which indicates points of discharge to the POTW from the regulated processes;
         (b)   Types of wastes generated, and a list of all raw materials and chemicals used or stored at the facility which are, or could accidentally or intentionally be, discharged to the POTW;
         (c)   Type and amount of raw materials processed (average and maximum per day).
      (9)   Name and location of other similar industrial facilities operated by the person(s) making application to the town;
      (10)   Site plans, floor plans, mechanical/plumbing plans, and details to show all drains, sewers, sewer connections, etc. and by the size, location and elevation of each. These plans must show all points of discharge;
      (11)   The location for monitoring all wastes covered by the permit (a site plan showing the locations of the monitoring points must be included);
      (12)   Description of wastewater discharge rates to include:
         (a)   Average daily flow
         (b)   Maximum hourly flow
         (c)   Instantaneous or batch type flows
         (d)   Time and duration of discharges;
         (e)   Maximum daily flow
         (f)   Wastewater flows should be segregated to sanitary, industrial/process, cooling water, and total.
         (g)   Information showing the measured average daily and maximum daily flow, in gallons per day, to the POTW from regulated process streams and other streams, as necessary, to allow use of the combined wastestream formula set forth in the pretreatment regulations.
      (13)   Analytical data on wastewater constituents and characteristics including but not limited to those mentioned in this chapter. The results of sampling and analysis identifying the nature and concentration, and/or mass, where required by the standard or by the Chief Operator, of regulated pollutants in the discharge from each regulated process. Instantaneous, daily maximum, and long-term average concentrations, or mass, where required, shall be reported. Should the user operate a similar facility not served by the town, analytical data, discharge monitoring results, etc. from such facility shall be submitted with the application;
      (14)   The sample shall be representative of daily operation and shall be analyzed in accordance with procedures set out in § 50.162 of this chapter. Where the standard requires compliance with a BMP or pollution prevention alternative, the user shall submit documentation as required by the Chief Operator or the applicable standards to determine compliance with the standard.
      (15)   Measurement of pollutants.
         (a)   The categorical pretreatment standards applicable to each regulated process and any new categorically regulated processes for existing sources.
         (b)   The results of sampling and analysis identifying the nature and concentration, and/or mass, where required by the standard or by the Chief Operator, or regulated pollutants in the discharge from each regulated process.
         (c)   Instantaneous, daily maximum, and long-term average concentrations, or mass, where required, shall be reported.
         (d)   The sample shall be representative of daily operations and shall be analyzed in accordance with procedures set out in § 50.162 of this chapter.
      (16)   Where known, the nature and concentration of any pollutants in the wastewater which are limited by any local limitations, or national categorical pretreatment standards, a statement regarding whether or not the person is complying or will comply with national categorical pretreatment standards on a consistent basis and, if not, whether additional pretreatment or operational modifications are required to comply with applicable limitations or national categorical pretreatment standards, or local limitations;
      (17)   Any requests for a monitoring waiver (or a renewal of an approved monitoring waiver) for a pollutant neither present nor expected to be present in the discharge based on the requirement in this chapter.
      (18)   Wastewater operator name, grade, license numbers, contact information must be included in the application, if applicable. The operator or record and the roster of operators should be submitted;
      (19)   Acknowledgment by the applicant that he or she will:
         (a)   Furnish any additional information which the town believes is appropriate in the evaluation of the application;
         (b)   Accept and abide by all provisions of this chapter and all other applicable local, state, and federal requirements;
         (c)   Operate and maintain any pretreatment facility, as may be deemed necessary, to ensure compliance with this chapter and national pretreatment standards.
         (d)   To cooperate fully at all times with the town, DHEC, and EPA in their inspecting, sampling, and study of the industrial wastes, and any facilities provided for pretreatment.
         (e)   To notify the town immediately after becoming aware of any accident, spill, slug, or other occurrence that may produce a violation of this chapter, NPDES permit, etc.
      (20)   All wastewater discharge permit applications and industrial user reports must contain the following certification statement and be signed by an authorized representative of the industrial user. The certification statement can be found in § 50.164. If the designation of an authorized representative is no longer accurate because a different individual or position has responsibility for the overall operation of the facility or overall responsibility for environmental matters for the company, a new written authorization satisfying the requirements of this ordinance must be submitted to the Chief Operator prior to or together with any reports to be signed by an authorized representative.
   (C)   Upon receipt of a complete application package, the town will within 30 days issue its initial approval or disapproval of the application. Formal or final approval of the application for service will be granted with the issuance of a permit to discharge.
   (D)   Incomplete or inaccurate applications will not be processed and will be returned to the user for revision.
   (E)   Those persons denied service or service approved subject to conditions he or she deems unacceptable, shall have the right to request a formal hearing under the procedures established in §§ 50.185 through 50.189 of this chapter.
