(A) The Chief Operator shall evaluate whether each SIU needs an accidental discharge/slug discharge control plan or other action to control slug discharges. The Chief Operator may require any user to develop, submit for approval, and implement such a plan or take such other action that may be necessary to control slug discharges. an accidental discharge/slug control plan shall address, at a minimum, the following:
(1) Description of discharge practices, including non-routine batch discharges.
(2) Description of stored chemicals.
(3) Procedures for immediately notifying the POTW of any accidental or slug discharge. Such notification must also be given for any discharge which would violate any of the prohibited discharges.
(4) Procedures to prevent adverse impact from any accidental or slug discharge. Such procedures include, but are not limited to, inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site run-off, worker training, building of containment structures or equipment, measure for containing toxic organic pollutants (including solvents), and/or measures and equipment for emergency response.
(B) Should in the opinion of the town, S.C. DHEC, and/or EPA, the user must provide facilities to ensure protection from accidental discharge of prohibited materials or other substances regulated by this chapter, the user shall do such at his or her own expense. Installation of such facilities shall be accomplished based on an approved compliance schedule.
(C) Detailed plans, specifications, proposed operating procedures, etc. shall be submitted to the town and S.C. DHEC for review and approval, prior to the commencing of construction.
(D) New industrial users, who must comply with the provisions of this section, shall not commence discharge of waste water until such facilities are approved by the town and S.C. DHEC.
(E) Review and approval of plans, specifications, operating procedures, etc. shall not relieve the user of the responsibility to modify the facility as necessary to ensure conformance of this chapter.
(F) In the case of an accidental discharge or slug load, it shall be the responsibility of the user to immediately and verbally notify the town of the incident. The notification shall include location of discharge, type of waste, concentration and volume and corrective actions taken and those proposed to be taken, if known.
(G) Within five days following an accidental discharge or slug, the user shall submit a detailed written report to the town of the incident. The report shall describe the cause of the discharge and the measures to be taken to prevent future occurrences.
(H) A notice shall be permanently posted on the user's bulletin board or other prominent place advising employees whom to call in the event of an accidental or dangerous discharge. Employers shall insure that all employees who may cause or suffer a dangerous discharge to occur are advised of the emergency notification procedure.
(I) The town has the authority to halt or prevent the discharge of any user for noncompliance to protect the system's collection and treatment.
(J) Failure to comply with provisions set forth in this section will be considered significant non-compliance.
