§ 113.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   FENCE. A structure forming a physical barrier which is so constructed that no less than 50% of the vertical surface is open to permit the transmission of light, air, and vision through the surface in a horizontal plane.
   JUNK. Includes old or scrap metal, rope, rags, batteries, paper, trash, rubber, debris, waste, or junked, dismantled, or wrecked automobiles, or parts thereof.
   JUNK AUTO. Any automobile, truck, or other vehicle which meets two or more of the following conditions: damaged, such as body damage, broken windows, or windshields, missing wheels, tires, motor or transmission; unlicensed; or inoperable.
   JUNKYARD. A junkyard is an establishment or place of business which is maintained, operated or used for storing, keeping, buying, or selling junk, or for the maintenance or operation of an automobile graveyard. This definition includes scrap metal processors, auto-wrecking yards, salvage yards, scrap yards, auto-recycling yards, parts awaiting disposal as a normal part of a business operation when the business will continually have like materials located on the premises. The definition includes garbage dumps and sanitary landfills. The definition does not include litter, trash, and other debris scattered along or upon the highways, or temporary operations and outdoor storage of limited duration.
      (1)   AUTOMOBILE GRAVEYARD. An establishment or place of business which is maintained, used, or operated for storing, keeping, buying, or selling wrecked, scrapped, ruined, or dismantled motor vehicles or motor vehicle parts.
      (2)   ILLEGAL JUNKYARD. An illegal junkyard is one which is established or maintained in violation of this chapter.
      (3)   NON-CONFORMING JUNKYARD. A non-conforming junkyard is one which was lawfully established, but which does not comply with the provisions of this chapter. Illegally established junkyards are not non-conforming junkyards.
   LOT. Land occupied or intended for occupancy by use permitted in these regulations. The word LOT includes site, yard, or parcel.
   MAIN TRAVELED WAY. The traveled way of a highway on which through traffic is carried. In the case of a divided highway, the traveled way of each of the separated roadways for traffic in opposite directions is a main traveled way. It does not include such facilities as frontage roads, turning roadways or parking areas.
   OPEN STORAGE. A yard, lot, site, or portion thereof, designed or used exclusively for storage of junk as defined above.
   PERSON. A person shall mean any person, firm, partnership, association, corporation, company, or organization of any kind.
   USE. Any activity, occupation, business, or operation carried on, or intended to be carried on, in a building or other structure or on a tract of land.
   USE, ACCESSORY. A use located on the same lot with a principal use, and is clearly incidental or subordinate to, and customary in connection with, the principal use.
   USE, NON-CONFORMING. The use of land or a building or portion thereof which does not conform with the regulations of this chapter.
   USE, PRINCIPAL. The main or primary use on a lot.
   VISUAL SCREEN. A visual screen is a static barrier which retrains and/or shields from view a specified object or objects. For purposes of this chapter “objects” refers to junk or junkyards.
   WALL. A structure forming a physical barrier which is so constructed that no less than 50% of the vertical surface is open to permit the transmission of light, air, and vision through such surface in a horizontal plane.
