§ 90.32 BARKING DOGS A MENACE.
   (A)   The barking or howling of any dog to such an extent or so continuously as to materially interfere with or affect the health, comfort, peace and quiet or dignity of the public is hereby declared to be a nuisance and any person harboring or keeping in his/her possession such animal who shall fail and refuse to take such action or do such things as will abate such nuisance when requested to do so by the Animal Control Officer or the police shall be guilty of misdemeanor.
   (B)   Upon the receipt of two written and signed complaints, from separate households in close proximity to the offender, that a person is violating the provisions in (A) above, the Animal Control Officer or other appropriate law or codes enforcement officer shall investigate the complaint. If the investigation determines that the complaint is justified, the Animal Control Officer or other appropriate law or codes enforcement shall notify the owner or keeper of the animal, in writing, to correct the violation.
   (C)   Should the owner or keeper of any animal found to be in violation of the provisions in (A) above, after 15 days of the date of notice, the owner or keeper shall be subject to the penalties in (A) above.
