§ 156.42 HEARING OFFICER TO CONDUCT ADMINISTRATIVE HEARING.
   (A)   A hearing officer shall be appointed to conduct an administrative hearing regarding the vested rights determination. The procedures for conducting hearings shall be approved by a resolution of the City Commission and incorporated in the Administrative Code. The hearing shall be set for no later than 60 days from the date of filing unless an extension of time is requested or agreed to by the applicant.
   (B)   The City Attorney shall represent the city in the administrative hearing. The hearing officer shall determine whether vested rights have been created pursuant to statute or established case law and shall determine whether any time limitation is applicable to such vested rights.
